Duty of care

The Workplace (Health, Safety and Welfare) Regulations 1992 set the baseline for the environment you ask people to work in - and in a commercial kitchen or a busy extraction-heavy plant, that baseline is doing a lot of quiet work.

Most employers meet these regulations without ever reading them, because good practice and legal duty tend to point the same way. But when air quality, temperature and equipment maintenance are the difference between a comfortable shift and a compensation claim, it pays to know exactly what the law expects of you. These regulations sit underneath almost everything Phoenix Duct Clean does - they are the reason ventilation has to actually work, the reason plant has to be maintained, and one of the reasons local exhaust ventilation testing is treated as non-negotiable rather than optional housekeeping.

What the 1992 Regulations actually cover

The Workplace (Health, Safety and Welfare) Regulations 1992 - usually shortened to the WHSW Regulations - are made under the Health and Safety at Work etc. Act 1974 and enforced by the Health and Safety Executive. They apply to almost every workplace in Great Britain, from a small takeaway to a distribution warehouse. They are supported by an Approved Code of Practice, published by the HSE as L24, which carries a special legal status: if you follow it you are generally taken to have complied with the law, and if you depart from it you may be asked to show you achieved compliance some other way.

The regulations are grouped around the working environment, welfare facilities, and the general condition of the workplace. The parts that matter most for anyone running kitchens, food production, or industrial extraction are the duties on ventilation, temperature, cleanliness and maintenance.

Ventilation (Regulation 6). Every enclosed workplace must have effective and suitable provision to ensure it is ventilated by a sufficient quantity of fresh or purified air. In practice that means fresh air drawn from outside, uncontaminated by discharges from flues, chimneys or process outlets, and circulated through the space to dilute and remove warm, humid or stale air. Where windows and natural airflow are not enough - which is almost always the case in a commercial kitchen - mechanical ventilation is required, and it has to be kept working.

Temperature (Regulation 7). The temperature in all indoor workplaces must be reasonable during working hours. The ACOP sets a normal minimum of 16°C, or 13°C where much of the work involves severe physical effort. There is no fixed legal maximum, but employers still have to keep temperatures comfortable and provide a way to measure them. A commercial kitchen is a useful illustration of why extraction matters here: without effective canopy extraction, the heat and humidity from cooking make a "reasonable" temperature almost impossible to sustain.

Cleanliness (Regulation 9). Workplaces, and the furniture and fittings within them, must be kept sufficiently clean. Dirt and refuse should not accumulate. Grease-laden ductwork sitting above a cooking line is exactly the kind of accumulation this regulation is aimed at - it is a hygiene issue, a fire risk, and a drag on the ventilation that Regulation 6 requires.

Maintenance (Regulation 5). The workplace, and any equipment, devices and systems, must be maintained in an efficient state, in efficient working order and in good repair. Crucially, where a device or system is provided to comply with the regulations - a mechanical ventilation system, for example - it must be subject to a suitable system of maintenance. This is the hook that turns cleaning and servicing from good practice into a legal expectation.

The numbers that anchor compliance

None of these are targets to aim at - they are ceilings and floors. The 14-month figure in particular is a maximum, not a default: higher-risk processes are examined far more often, and a system that keeps failing between tests needs attention long before the interval runs out.

Where COSHH and LEV testing come in

The 1992 Regulations set the general environmental duties. Once your process produces hazardous substances - grease vapour, wood dust, welding fume, solder fume, cooking aerosols - a second, more specific set of rules takes over: the Control of Substances Hazardous to Health Regulations 2002, or COSHH. The two work together. The WHSW Regulations say the workplace must be adequately ventilated and maintained; COSHH says that where you rely on engineering controls such as local exhaust ventilation to protect people, those controls must be proven to work.

Under COSHH Regulation 9, any LEV system provided to control exposure must be given a thorough examination and test at least once every 14 months. That two-month margin beyond a year exists so you can schedule sensibly, not so you can drift. Certain processes listed in Schedule 4 of COSHH demand far shorter intervals - wood dust and welding fume extraction are typically tested at least every six months, because of the established links to nasal cancer and serious respiratory disease. The examination itself follows the HSE's guidance in HSG258, checking that the system is performing as it was designed to and is actually capturing the contaminant at source.

This is where the stakes stop being abstract. Poorly controlled fume and dust are behind a large share of the occupational disease burden in the UK, and the financial exposure that comes with it is easy to underestimate - as we set out in the real cost of an occupational health claim, the bill for a single case can dwarf years of straightforward maintenance. The same logic applies whether you run a kitchen extraction canopy or a bench extractor over an electronics line; the specific respiratory hazards of processes like soldering and electronics assembly are precisely why LEV is fitted, and precisely why it has to be tested rather than assumed to be working.

Building a defensible maintenance regime

Meeting these regulations is less about heroic effort and more about a documented, repeatable routine. A sound approach usually includes:

  • A written scheme of maintenance for ventilation and extraction plant, so Regulation 5 is demonstrably satisfied rather than assumed.
  • Scheduled duct and canopy cleaning to keep grease accumulation down, protect airflow and reduce fire risk - with before-and-after evidence retained.
  • LEV thorough examination and testing at the correct interval for each process, not a blanket 14 months applied everywhere.
  • Records - cleaning certificates, LEV reports and repair logs - kept for at least five years and easy to produce for an inspector, an insurer or an auditor.
  • A simple way to measure and log workplace temperature, so you can show conditions stayed reasonable.

Handled this way, compliance stops being a scramble before an inspection and becomes a paper trail you can hand over on request. That trail is also your best protection if something ever goes wrong - it shows you took the environment your people work in seriously, and that the systems meant to protect them were proven, not presumed.
