How to keep an older workshop compliant without a rebuild

Old does not mean illegal

There is a persistent worry among people running older premises that age itself is the problem: that a workshop built decades ago, full of machines older than some of the staff, must be a rebuild away from compliance. It is an expensive assumption and, for the most part, a false one. The law that governs work equipment is deliberately indifferent to age. The Provision and Use of Work Equipment Regulations require that equipment is safe to use whatever its age, condition or origin, and that test is about safe use today, not about when something was made.

That distinction matters because it changes the question from can we afford to replace all this to what would actually make it safe. A forty-year-old pillar drill with a well-designed guard, a working emergency stop and a sound electrical supply can be entirely compliant. A gleaming new machine with a defeated interlock is not. Compliance lives in the guarding, the controls, the maintenance and the exposure control, none of which requires the whole shop to be modern.

The same logic runs through the control of dust and fume. An old workshop is not required to be rebuilt to control exposure; it is required to control exposure. Very often that is achieved by adding to what exists rather than replacing it, and the cost of doing so is a fraction of the rebuild that people fear is coming.

The practical route to compliance in an older workshop is a series of targeted upgrades, each aimed at a specific risk. Guarding can be added or improved on machines that never had modern safeguards. Emergency stops and clearly marked controls can be fitted where they are missing. Where a process makes dust or fume, on-tool or local extraction can be retrofitted to capture it at source, without touching the machine's basic function. These are additions, not reconstructions, and they are how most older shops close the gap.

Existing extraction is a good example of the principle. An older local exhaust ventilation system is not automatically inadequate; it needs to be examined and tested, at least every fourteen months under COSHH, to establish whether it still captures what it was built to capture. Often an ageing system needs a repair, a rebalance or a better hood rather than a wholesale replacement, and testing is what tells you which. Spending on a rebuild before you know whether the current system works is how money gets wasted at both ends.

None of this removes the duty to assess. The workshops that get into trouble are rarely the ones with old equipment; they are the ones that assumed age alone was fine, or assumed age alone was fatal, and did nothing either way.

A tidy old workshop that can prove its guards work, its extraction is tested and its people are trained stands on far firmer ground than a modern one that cannot.
