The Compliance Gap That Voided a Claim

A kitchen fire is bad enough. Discovering that a paperwork gap has voided your insurance claim is worse. Here is how one avoidable compliance gap turned a routine fire into a business-ending loss.

The fire started where these fires almost always start - in the grease lining the extract duct above the range, out of sight and long overdue a clean.

Picture a busy restaurant kitchen running fourteen hours a day. One evening a flare-up on the chargrill drew flame up into the canopy, caught the grease film coating the ductwork, and ran the length of the extract system before anyone reached the isolator. The fire was contained, thankfully, with no injuries. The damage to the building and the fit-out ran well into six figures, and the business did what any business would do - it called its insurer.

The claim was declined. Not because the policy did not cover fire, and not because anyone suspected foul play. It was declined because, buried in the schedule, the policy carried a condition precedent requiring the kitchen extract system to be cleaned to a recognised standard and for that cleaning to be evidenced. The owner genuinely believed the system was being cleaned. A contractor had visited. But when the loss adjuster asked for the paperwork, the compliance gap opened up - and the whole claim fell through it.

Where it went wrong

The recognised standard for cleaning commercial kitchen extract systems in the UK is TR19® Grease, published by BESA (the Building Engineering Services Association) in 2019. It is the benchmark loss adjusters reach for, and increasingly the exact wording insurers name in their policy conditions. The owner in this case was not ignoring it - they had simply misunderstood what compliance actually looks like. Three things unravelled under scrutiny.

Only the reachable sections were cleaned. The contractor had wiped down the canopy, changed the filters and cleaned the first accessible run of duct. Everything beyond the nearest bend - the long horizontal run and the riser, precisely where the fire travelled - was never touched, because there were no access panels to reach it. TR19® Grease is explicit that the entire extract route must be cleaned, not just the parts you can see. Guidance such as DW/172 calls for enough access panels along the duct to allow inspection and cleaning throughout. Without them, large stretches of greasy duct sit untouched clean after clean.

No grease levels were measured. Compliance is not a matter of opinion about whether a duct "looks clean". TR19® Grease sets measurable thresholds. Grease deposit is measured in microns using a Deposit Thickness Test or Wet Film Thickness Test. Below 200 microns a system is broadly acceptable; between 200 and 999 microns cleaning is due; at 1,000 microns or more you have a serious, combustible fire load that needs dealing with immediately. After a clean, a verification test should confirm deposits are down below 50 microns. None of this had been measured, so there was no way to prove the system had ever been brought to a compliant condition.

There was no post-clean verification report. This was the fatal gap. A Post-Clean Verification Report records what was cleaned, the grease readings before and after, before-and-after photographs, the areas that could not be accessed, and the recommendations arising. It is the single document that turns a visit into evidence. The kitchen had a couple of invoices and no report. To the loss adjuster, that read as no defensible proof of compliance at all.

Why the numbers matter

Insurers lean on TR19® Grease because it converts fire risk into figures anyone can check. The cleaning frequency alone would have flagged this kitchen as high risk. TR19® Grease ties minimum cleaning intervals to how many hours a day the kitchen runs - a heavy-use kitchen operating twelve to sixteen hours a day should be cleaned roughly every three months, a moderate-use site every six months, and a light-use site every twelve. This kitchen ran fourteen hours a day and had last had any work done many months earlier. On the standard’s own frequency table it was long overdue, and that fact alone gave the insurer a clean reason to decline.

It is worth being clear about the legal frame around all this too. Under the Regulatory Reform (Fire Safety) Order 2005, the responsible person for the premises must manage fire risk, and a grease-laden extract system is a textbook source of that risk. A voided insurance claim is one consequence of getting it wrong. Enforcement action, and personal liability for the responsible person, is another. The extract system is not a minor line item - it is one of the highest fire-risk assets in the whole building, and it needs treating that way in your budgeting. The fix

The reassuring part is that closing this gap is straightforward and, against the cost of an uninsured fire, cheap. If you want your next clean to actually protect you, insist on the following - and keep the evidence.

  1. Read your policy schedule first. Find the exact wording of any clause covering extract cleaning. Note whether it names TR19® Grease, whether it sets a required frequency, and whether it is written as a condition precedent - because if it is, non-compliance can defeat a claim outright rather than merely reducing it.
  2. Fit proper access. Have the full duct route surveyed and access panels installed at the intervals the guidance calls for, so every section can be reached, inspected and cleaned. A system you cannot access is a system you cannot prove is clean.
  3. Clean the whole system to the standard. The canopy, filters, plenum, the full length of ductwork, the riser and the fan - not just the parts within arm’s reach of the kitchen. This is the difference that would have stopped the fire travelling.
  4. Measure, do not guess. Insist on grease readings taken with a Deposit Thickness Test or Wet Film Thickness Test, before and after, with post-clean levels confirmed below 50 microns.
  5. Get the Post-Clean Verification Report. Before-and-after photographs, grease readings, a clear note of any sections that could not be accessed, and the recommendations arising. This report is the document your insurer will ask for.
  6. Set the frequency to your hours and diarise it. Match the interval to your daily operating hours and book the next visit before the current one is invoiced, so you never drift out of date.
  7. Keep an unbroken file. Certificates, verification reports, photographs and a record of any remedial work you commissioned in response to recommendations. Continuity is what makes the file defensible when it is tested.
